These Terms of Service govern access to and use of the Érudits website (www.erudits.com) and the general services offered through it. By accessing or using this website, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use this website.

Érudits may update these Terms from time to time. Continued use of the website after changes are posted constitutes acceptance of the revised Terms.

II. ABOUT ÉRUDITS

Érudits provides French language teaching resources, revision materials, and examination preparation support to secondary school students and teachers.

You agree to use the Érudits website only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the website by, any third party.

Prices for products and services listed on the Érudits website are in Australian Dollars (AUD) and are inclusive of GST, unless stated otherwise. Érudits reserves the right to change prices at any time; the price applicable to an order is the price in effect at the time the order is placed.

Payment is due upon invoice unless otherwise agreed in writing, and can be made by the payment method(s) made available at checkout or on the invoice, which may include electronic funds transfer or credit card.

Additional terms specific to individual products — including delivery, access, and refund conditions for examination packs — are set out in the relevant product-specific terms (see “Product-Specific Terms” below).

V. INTELLECTUAL PROPERTY

All content on the Érudits website — including text, graphics, logos, course materials, and the CERCLE™ Method — is the property of Érudits or its licensors and is protected by Australian copyright and trademark law, unless otherwise stated.

You may view and print pages from the website for your own personal, non-commercial use, or for use within your school in accordance with any applicable product-specific terms. You must not reproduce, republish, distribute, or commercially exploit any content from this website without Érudits' prior written permission.

VI. LINKED AND THIRD-PARTY SITES

The Érudits website may contain links to third-party websites, provided for convenience only. Érudits does not control and is not responsible for the content, accuracy, or practices of any linked site, and including a link does not imply endorsement.

Use of Érudits materials, including examination packs and revision resources, does not guarantee any particular academic result, examination outcome, or ATAR score.

IX. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Érudits excludes all liability for any direct, indirect, incidental, special, or consequential loss or damage arising out of or in connection with your use of the Érudits website or its content, whether based on contract, tort (including negligence), or otherwise.

Where liability cannot be lawfully excluded, Érudits' total liability for any claim is limited, at Érudits' option, to the resupply of the relevant goods or services, or the amount paid for the specific product or service giving rise to the claim.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded under the Australian Consumer Law.

X. INDEMNITY

You agree to indemnify and hold Érudits harmless against any claim, loss, or expense arising from your breach of these Terms or your misuse of the website or its content.

XI. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of Western Australia, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of Western Australia in respect of any dispute arising out of or in connection with these Terms or your use of the website.

If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed, and the remaining provisions will continue in full force and effect.

XIV. PRODUCT-SPECIFIC TERMS

These General Terms of Service apply to your use of the Érudits website as a whole. Purchases of examination packs are additionally governed by the Érudits Examination Pack – Terms of Use, which takes precedence over these General Terms in the event of any conflict regarding examination pack purchases specifically.
